These Terms of Use constitute a public offer and govern access to and use of the Latona platform, including the website, mobile application, related pages, communications tools, and any other digital interface through which Latona makes products, shops, delivery options, and related services available.By registering on the platform, placing an order, or otherwise using Latona, you confirm that you have read, understood, and accepted these Terms in full.If you do not agree with these Terms, you must stop using Latona immediately.
1. Definitions
For the purposes of these Terms, the following definitions apply:
Latona / Platform means the digital marketplace operated under the Latona brand, including its website, mobile application, associated software, user interfaces, and support tools.
User means an individual who uses the Platform to browse, order, pay for, receive, or otherwise interact with products or services available through Latona.
Recipient means the person designated by the User to receive a Product, if different from the User.
Seller means a legal entity or individual entrepreneur that offers Products for sale through the Platform.
Product means any food or non-food item, gift, flower arrangement, cake, basket, plant, accessory, or other item made available by a Seller through the Platform.
Order means a request placed by a User through the Platform for the purchase, pickup, or delivery of one or more Products.
Delivery means the delivery of a Product to the address specified in the Order.
Pickup means collection of a Product directly from the Seller without delivery.
Personal Account means the User profile created on the Platform, through which the User may manage personal details, addresses, Order history, payment methods, preferences, and other available functions.
Support Service means Latona’s customer support channels, including chat, email, in-app support, and any other communication tools made available by Latona.
High-Demand Day means a date or period designated by Latona when order volume is significantly increased and certain operational rules, cancellation rules, timelines, or limitations may apply.
Payment Provider means any bank, payment gateway, acquiring bank, card processing service, or other financial service provider used for payment processing, settlement, or refund operations on the Platform.
2. Nature of the Platform and Contractual Structure
2.1 Latona operates primarily as a technology marketplace and intermediary platform that enables Users to browse Products, place Orders, communicate through platform tools, make payments, and receive information and support in relation to Orders.
2.2 Unless expressly stated otherwise for a specific service or product category, the contract for the sale of Products is concluded directly between the User and the relevant Seller.
2.3 The Seller is responsible for the Product itself, including its quality, composition, description, legality, availability, packaging, fulfillment, and compliance with applicable law.
2.4 Where Delivery is offered, the Seller may perform delivery independently or through Latona, a courier partner, or another third party. Regardless of who physically performs delivery, the Seller remains responsible for proper fulfillment of the Product order, except where mandatory law provides otherwise.
2.5 Latona may provide platform-level services, including but not limited to search, catalog access, order placement tools, payment facilitation, customer notifications, support routing, pre-delivery photo functionality, pickup code functionality, and complaint intake.
